Understanding AODA Compliance
What is the AODA?
The Accessibility for Ontarians with Disabilities Act (AODA), passed by the Ontario Government in 2005, aims to eliminate barriers for individuals with disabilities. The AODA’s mission is to create accessibility standards to ensure equal access to goods, services, facilities, employment, accommodations, and spaces for Ontarians with disabilities by January 1, 2025. This legislation mandates standards development across public and private sectors in Ontario, encompassing physical and digital accessibility—such as websites and applications.
Who Needs to Comply with AODA?
The AODA mandates that all organizations in Ontario's public and private sectors adhere to its accessibility standards. Notably, it requires organizations to update all internet and intranet websites and web content to WCAG 2.0 Level AA standards by January 1, 2020. Pre-2012 web content is exempt unless updated, in which case it must meet current WCAG standards.
Enforcement of AODA Compliance
The AODA imposes significant penalties for non-compliance. Individuals and non-corporate entities may face fines of up to CA$50,000 per day, while corporations could incur up to CA$100,000 per day until the violation is resolved.

Build an inclusive workplace with expert support
Under Ontario’s Accessibility for Ontarians with Disabilities Act, employers are required to make their workplace accessible for employees and job applicants with disabilities – up to the point of undue hardship. Failure to provide reasonable accommodations may expose your business to litigation, employee claims, financial penalties, and hurt your business reputation. Those found guilty of an offence under this Act are liable to a fine of up to $50,000 for each day the violation continues. Corporations that violate AODA standards are liable to be fined up to $100,000 per day.
